When you place an order, you are making an offer to purchase. Ethereal Elegance Aromatics LLC reserves the right to accept or decline any order for any reason at its sole discretion. Your order is not accepted until Ethereal Elegance Aromatics LLC confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting. Once an order is accepted, cancellations are not guaranteed. If you wish to request a cancellation, you must contact us as soon as possible at contact@eearomatics.com. We will make reasonable efforts to accommodate cancellation requests received before an order has been fulfilled or shipped, but we cannot guarantee cancellation after acceptance.

In the event that we do not accept, modify, or cancel an order, we will attempt to notify you via the email, billing address, and/or phone number provided at the time of the order.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

The price charged for a product will be the price in effect at the time the order is placed, as confirmed in your order confirmation email. SECTION 5 — SHIPPING AND DELIVERY

We are committed to fulfilling your order promptly and carefully. All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, weather, or events outside our reasonable control.

Once we transfer your order to the carrier, title and risk of loss passes to you. Ethereal Elegance Aromatics LLC is not liable for loss, theft, or damage occurring after the package has been transferred to the carrier.

However, we understand that shipping issues are frustrating and we will work with you in good faith to investigate and remediate problems such as lost or missing packages. In the event of a lost shipment, we will open an investigation with the relevant carrier on your behalf. Resolution is subject to the carrier's findings and policies, and we cannot guarantee replacement or refund in all circumstances, particularly where the carrier determines the package was delivered or where the postal carrier's investigation does not result in a finding in your favor.

However, all sales and purchases made in our store are made directly with Ethereal Elegance Aromatics LLC. For disputes that cannot be resolved informally, you and Ethereal Elegance Aromatics LLC agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services through binding individual arbitration, rather than in court, except that either party may bring individual claims in small claims court if they qualify.

YOU AND ETHEREAL ELEGANCE AROMATICS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.

Arbitration will be conducted under the rules of the American Arbitration Association (AAA) or a mutually agreed-upon arbitration provider. The arbitration will take place in State of Michigan, United States of America, or at a mutually agreed location. The arbitrator's decision will be final and binding.

Nothing in this section shall prevent either party from seeking injunctive or equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

SECTION 20 — GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Michigan, United States of America, without regard to its conflict of law provisions. You and Ethereal Elegance Aromatics LLC consent to the exclusive venue and personal jurisdiction of the state and federal courts located in Michigan for any matters not subject to arbitration under Section 19.
